DURABLE POWER of ATTORNEY

The California probate code allows for a Durable Power of Attorney that allows you to name an agent for business or health care decisions, even if you become incapacitated. You have the right to revoke these powers unless you are incompetent. You should carefully consider the consequences of giving the "'wrong person the ability to manage your affairs, dispose of assets or make serious health care decisions.

The Special Power of Attorney for health care decisions allows the named agent to:

I) consent;

2) refuse; or

3) withdraw from any care or treatment plan

This power also allows your agent to make decisions about autopsies and anatomical gifts
